Course Information

Drafting of Power of Attorney documents (financial and healthcare) has statutorily required substantive and procedural requirements and must include provisions that meet the needs and goals of the client. When working with clients who may have capacity issues resulting from age and/or disability, the attorney is required to determine if the client has the legal capacity to execute such documents and treat the client with diminished capacity as required under RPC 1.14 and other related ethical rules. This session will discuss these interrelated aspects of drafting Power of Attorney documents and challenging hypothetical situations where these rules apply.
